Concern over the fallibility of eyewitness memory is well documented (e.g. Loftus 1974). However, this research has usually focused on actual events that have been witnessed. Much less is known about the effects of our own motives on our recall accuracy.
A copyright infringement case in 2002 involved the singer Eminem being sued by a French music composer, Jacques Loussier, who claimed that the track ‘Kill you’ included sampled beats from Loussier’s original work. Loussier further claimed that Eminem’s album success was due in large part to the popularity of that specific song track.
