The US Supreme Court

Power and politics

How and why did the Supreme Court overturn Roe v Wade, and what are the implications of this decision?

AQA: the nature of judicial power, the significance of judicial review, the significance of the judiciary, checks and balances. Edexcel: the extent of the power and effectiveness of checks and balances, relationships between the presidency, Congress, and Supreme Court.

On 24 June 2022 the US Supreme Court overruled Roe v Wade (1973) with its Dobbs v Jackson Women’s Health Organization (2022) judgement. Dobbs directly challenged the precedent set in Roe, that abortion is an inherent right for pregnant women (see Box 1). In a 6–3 judgement the Court concluded that abortion was not protected under the Constitution, thus overturning Roe.
