AB and Others v Ministry of Defence (2012)

The case involved the interpretation of sections 11 and 14 of the Limitation Act 1980 and whether a claimant’s belief that his injury was capable of being caused by an act or omission of a defendant was sufficient to satisfy the requirement of ‘knowledge’ in these sections. The claimants were ex-servicemen who had been involved in atmospheric nuclear tests in Australia and on Christmas Island in the Pacific Ocean. They sought damages for injuries to their health as a result of being exposed to radiation.
