Oblique intent

Ian Yule gives advice on answering questions on oblique intent, which is often a tricky area for students

This Examination Focus is relevant for AQA Law Units 2 and 3, and OCR A2 Unit G153: Criminal Law.

This topic seems to create major difficulties for students in AS exams when they have to explain what ‘intention’ means. It tends to cause even greater problems in A2 murder questions, where often this is the key mens rea issue to be addressed. Oblique intent can be relevant only in specific intent crimes — murder and s.18 malicious wounding and/or causing grievous bodily harm with intent — i.e. offences where the Crown has to prove that the defendant intended both the wrongful action and the specific consequence.
