Reforms to the laws of provocation and diminished responsibility

After huge amounts of criticism over many years, problem cases galore, and even a detailed Law Commission report, the royal assent was given last November to the Coroners and Justice Act 2009, which introduces sorely-needed reforms to both provocation and diminished responsibility. Commencement of these new rules is in October 2010.

Under s.54, the word ‘provocation’ disappears to be replaced by a new defence — loss of control. This section states that:
