Examining occupiers’ liability to trespassers

Ian Yule provides the concluding part to his examination focus coverage of occupiers’ liability in the law of tort, turning his attention to liability to trespassers and other non-visitors.

This article is written as a sequel to the article on occupiers’ liability to lawful visitors (‘Occupiers’ Liability Act 1957’) that appeared in the September 2009 issue, and in similar vein, it is based on the problems that occur in problem-solving questions relating to the legal rules in the Occupiers’ Liability Act 1984 and shows how these need to be dealt with. This article is also intended to illustrate the need for a planned and structured approach to answering such questions effectively.

This article is relevant for AQA A2 Unit 4 (tort option: occupiers’ liability) and OCR A2 Unit G157: Law of Torts (Occupiers’ Liability Acts 1957 and 1984).
