Defining misrepresentation

Examine the three types of misrepresentation

This article is relevant to AQA A-level Paper 3A, OCR A-level Component 3, WJEC A-level Units 3 and 4, and Eduqas Components 2 and 3.

Arepresentation is where a party makes a statement, for example, about the age and condition of a car: ‘Mini Countryman for sale, registered in 2020, one previous owner, 10,000 miles, excellent condition.’ When this statement turns out to be untrue — because the car had two previous owners and was registered in 2017 — this turns a representation into a misrepresentation and this is actionable and a party can sue.
