Real and informed consent, and the exceptions to this defence

This article is relevant to: OCR Unit 1 (criminal law), Eduqas Component 2 (criminal law) and WJEC Units 2 and 3.

In answering a non-fatal offences scenario, students may be required to discuss the defence of consent. This is a complete defence that, if successful, results in an acquittal. If it arises, it could be a central issue or just one aspect of an answer. It is therefore important for students to be able to clearly outline the key features of the defence and understand how to explain and apply them in an exam.
