Hoyle v Hampshire County Council (2022)
The victim’s car had been hit by a falling tree as he was driving past and he died at the scene. The tree had been on land adjacent to the road and the land was owned by the defendant. A claim was brought under the Fatal Accidents Act 1976 against Hampshire County Council, which included their tree surveyors responsible for maintenance of council land.
