Human rights law: trespass and public order

The criminal law of trespass can be used in a public order context and has links to human rights

This article is relevant to OCR Component 3, AQA Paper 3B, WJEC A-level Units 3 and 4, and Eduqas Components 2 and 3.

Trespass to land is concerned with entry onto land without express or implied permission or where any such permission has been exceeded or withdrawn. Most trespass is a civil matter governed by the tort of trespass to land that is enforced by private individuals rather than the state. Students are therefore often surprised to learn that despite widespread use of signs warning that trespassers will be prosecuted, trespass is not normally a criminal offence.
