Tort defences

Anna Stokes provides an overview of two general tort defences, of particular relevance to the tort of negligence

This ‘Examination focus’ is relevant to AQA Paper 2, OCR Component 2, Eduqas Components 2 and 3 and WJEC Unit 2.

Defences to negligence can be a part of negligence problem scenarios, as well as appearing as a stand-alone examination topic. There are two main defences to focus on: volenti non fit injuria and contributory negligence under the Law Reform (Contributory Negligence) Act 1945. These defences may also have application to other torts against the person and against property.
