Murder is a popular choice when it comes up in an exam question, but students do not always maximise the potential marks. One area that is often underdeveloped is the explanation of mens rea and its application to the facts of the scenario. To achieve the highest marks, it is vital that all aspects of the offence are fully explained and discussed. This ‘Examination focus’ sets out the relevant elements of the actus reus and mens rea of murder.
