Scenario questions are a common method of assessment across all examination boards for A-level law. In criminal law, you may be given a specific offence or defence, in order to allow you to discuss the defendant’s liability. Or the command line of the question may be more open, e.g. ‘Advise X on their liability for the death of Y’ or ‘Advise Z on their liability for nonfatal offences against the person’. In these types of questions students often go down the wrong path and end up missing out on marks as a result.
