Domestic courts have an important role to play in human rights cases. Each member state of the Council of Europe (of which the UK is one of 47 states) has a positive obligation to protect human rights under the European Convention on Human Rights (ECHR) and a negative obligation not to interfere with them. State measures that fail to meet this obligation can be challenged in national courts.
