Vicarious liability: no longer on the move?

Two recent Supreme Court judgments have brought welcome clarity and coherence to this important tort topic

This article is relevant to AQA A-level Paper 2 (tort law) and OCR A-level Component 2 (law of torts).

During the ‘Christian Brothers’ case (Various Claimants v Catholic Child Welfare Society, 2012), Lord Phillips declared that ‘the law of vicarious liability is on the move.’ He was describing developments in the case law that seemed to extend the imposition of liability on businesses and organisations beyond the original guiding principles of this area of law.
