I have marked thousands of candidates’ responses to scenario questions and the main deciding factor that separates a good response from a bad one is having a plan on how to tackle the question. It is simply not enough to be able to recount or recite the law — you must be able to apply all of the law relevant to the scenario. A common error is where candidates are selective with which parts of the law they apply, for example only applying the actus reus of theft and not the mens rea.
