The case of Thabo Meli v R (1954) will be familiar to many of you studying the principle of coincidence of actus reus and mens rea in criminal law. However, few textbooks provide any details of the actual case or consider the appropriateness of the decision in terms of legal principle. The case merits a closer look and provides an interesting example of how a legal issue can be viewed from different perspectives.
