In October 2017 the Supreme Court, in the civil case of Ivey v Genting Casinos (UK) Ltd t/a Crockfords, established a new test and definition for ‘dishonesty’ under the criminal law. In this case, the court preferred the civil law’s test for dishonesty and distanced itself from the existing criminal law test that had stood since 1982.
