R v Farnon and Ellis (2015)

Four appellants (J, aged 14, N, 16, and two other young persons) visited a derelict building. While inside they set fire to a discarded duvet, which was on top of a pile of discarded tyres. Once it was lit, they left. The duvet melted onto the tyres, which caught alight. Within 5 minutes thick, acrid smoke filled the basement rooms, killing a homeless Polish male who was in the building at the time. J and N were arrested and subsequently charged and convicted with manslaughter through an unlawful and dangerous act, but acquitted on a count of ‘arson — being reckless as to whether life was endangered’ and convicted with the lesser charge of ‘arson’.
